In the pharmaceutical sector, timing is everything – especially when it comes to patent filing. For startups, navigating the complex and high stakes world of drug discovery, knowing when to file a patent can be just as critical as knowing what to file. Poorly timed filings can undermine the strength, scope, and commercial value of a patent, potentially jeopardizing the startup’s competitive edge and investment potential.

2) Align patent filing with development milestones. Filing too early can lead to speculative claims. Filing too late can result in missed protection opportunities. Ideally, patent applications should be filed when there is enough data to support the invention. Follow up patent filings can be used to capture new data or applications.

3) Use divisional applications. A divisional application is a type of patent application that is derived from an earlier (“parent”) application. It allows applicants to pursue protection for subject matter disclosed in the parent application but not claimed in it. For example, a divisional application can be useful for protecting different aspects of an invention, such as methods of use, formulations, or combination therapies. Keeping the parent application pending allows startups to file divisional applications to pursue these additional claims.

5) Balance patent lifetime with regulatory timelines. Drug development can take 10-15 years, which may erode effective patent life. Startups should consider supplementary protection certificates or patent term extensions where available, and time filings to maximize exclusivity at product launch.
