EUIPO Mediation: Efficient Dispute Resolution for EUTMs & EU Designs

European News 05/06/2025

As of June 2, 2025, the European Union Intellectual Property Office (EUIPO) has expanded its mediation services to cover all inter partes proceedings.

This means if you're involved in EU trade mark (EUTM) opposition or cancellation proceedings, or registered EU design (EUD) invalidity proceedings (at both first and second instances), you can now opt for mediation to resolve your dispute amicably and efficiently.

Key Benefits of EUIPO Mediation for IP Disputes

Traditional IP disputes can be costly and time-consuming. Alternative Dispute Resolution (ADR), especially mediation, offers significant advantages for businesses seeking to protect their intellectual property rights:

  • Cost-Effective: Mediation helps avoid expensive litigation and associated legal fees.
  • Time-Saving: Settle disputes faster than through lengthy court processes.
  • Legal Certainty: Achieve clear, mutually agreed-upon, and legally binding solutions.
  • Confidentiality: The mediation process remains private, protecting sensitive business information.
  • Flexibility: Tailored solutions can be reached that align with your specific business interests.
  • Free & Online: The EUIPO Mediation Centre provides these services voluntarily and free of charge, accessible entirely online via a secure platform.

Comprehensive Scope of EUIPO Mediation Services

Launched in November 2023, the EUIPO Mediation Centre leverages the Office's extensive experience in ADR. This expansion allows all users to benefit from mediation at the early stages of EUTM opposition, EUTM cancellation, and registered EUD invalidity proceedings.

Beyond core EUTM and EUD disputes, EUIPO's ADR framework can also incorporate parallel conflicts involving other IP rights such as copyright, domain names, and patents. This comprehensive approach allows for the resolution of all related pending disputes between parties across various jurisdictions, making it a versatile tool for IP dispute resolution.

This initiative is a crucial step in the EUIPO's strategy to extend ADR services to all inter partes proceedings, reflecting a strong commitment to providing accessible and effective dispute resolution mechanisms.

Shaping the Future of IP Dispute Resolution

Under its Strategic Plan SP2030, the EUIPO is continuously exploring new ADR services, including potential mediation solutions for geographical indications (GIs) and copyright. The Office actively involves users through platforms like the Mediation Stakeholders Network (MCSN) and Customer Panels to gather feedback and ensure the services meet user needs and expectations.

Choosing EUIPO mediation offers a strategic advantage for businesses looking for an efficient, confidential, and cost-effective way to resolve their intellectual property disputes.
